Why Mediation ?

As per the statistics in December 2022 about 85% of civil cases are still pending in our courts, which are around 27 millions in count. According to Bloomberg Businessweek

“If the nations judges attacked their backlog nonstop—with no breaks for eating or sleeping—and closed 100 cases every hour, it would take more than 35 years to catch up,”

So, as already our Judiciary is overloaded with cases getting a solution on our civil disputes or conflicts are not going to be easy and it would take many years. Infact to clear of the backlog our Judiciary has formed a Court annexed Mediation options for the litigating parties to opt for.

Given the above statistics now most people opt for private mediation. Private mediation is that the disputing parties can opt of third party trained and qualified Mediators to resolve their disputes. The advantages here are the decision making powers are with the disputing parties wherein the mediators will guide in a way an amicable solution is made by the disputing party themselves and it is an easy and faster way in finding a solution rather than to litigate through courts. ABOUT THE FOUNDER

T.PRABAKAR B.E.,B.L., - IIAM ACCREDITED MEDIATOR

Prabakar T is the founder of Private mediation. An experienced Engineer cum Lawyer with 33 years of hands on experience in business, contract development, Intellectual property and property management. He is a certified mediator and a QAP-2 accredited mediator by Indian Institute of Arbitration and Mediation(IIAM).

He is a good negotiator, effective listener, motivator who has been successful as an entrepreneur with hands on experience in developing and dealing with Contracts, Intellectual property, Human resources and Government Licenses. He has successfully mediated property disputes which were under litigation. He believes that the Mediation as the most cost and time effective Alternative Dispute Resolution (ADR).

He adopts facilitative style of mediation wherein the mediator does not insert any opinion but rather help the parties in dispute find out solution by themselves to the underlying problems that had given rise to a dispute or litigation.
